It sets out what FairHome intends, so the work can be reviewed. It has not been through legal review, it is not binding, and the sections listed as outstanding are genuinely missing.
These terms describe the intended rules and responsibilities that apply when using FairHome.
What FairHome provides
FairHome brings together available property information, evaluates what it shows and provides tools that can help users understand assessments, exemptions, comparables, appeal-related information and supported property changes over time.
Available information and capabilities vary by jurisdiction. FairHome is not a government agency and has no authority over assessments, exemptions, appeals or tax bills.
Informational service — no guaranteed outcome
FairHome results, analyses, calculations and estimates are informational. They do not guarantee an assessment reduction, exemption approval, appeal outcome or tax savings and are not legal, tax or financial advice.
Users remain responsible for reviewing official requirements and deciding whether to appeal, claim an exemption, submit evidence or take another action. Time-sensitive information such as filing windows should be confirmed with the applicable official source.
Public property information and ownership
The ability to look up or save publicly available property information does not mean FairHome has verified that the user owns the property or is authorized to act for it. FairHome may require additional verification before permitting actions that require ownership or authorization.
Accounts and user-provided information
Users are responsible for information they submit to FairHome and for maintaining the security of their account credentials. The final terms must define account eligibility, registration requirements, permitted account use and the circumstances in which an account may be restricted or terminated.
The final terms must also establish the rights and responsibilities that apply to documents, evidence, comments or other content a user uploads or creates in FairHome.
Acceptable use
The final terms must define prohibited conduct, including misuse of accounts, attempts to interfere with the service, unauthorized access, unlawful use and any restrictions on automated collection, scraping or redistribution of FairHome content or data.
Those restrictions must be written to match FairHome’s actual public-data sources, licenses and product design rather than implying ownership of government records that FairHome does not own.
Service availability, changes and fees
FairHome capabilities depend in part on external government sources and other services that may change or become unavailable. The final terms must describe FairHome’s rights and obligations regarding service changes, interruptions and discontinued capabilities.
Any paid plans, fees, renewals, cancellations or refunds must be described only after the commercial model and checkout implementation are finalized.
Before these terms can be published
The contracting entity, user eligibility, account and termination rules, user-content terms, acceptable-use restrictions, service availability, commercial terms, warranties and disclaimers, limitation of liability, indemnification, dispute resolution, governing law and other required consumer terms must be settled with counsel.
